Some of the worst injuries occur in motorcycle accidents. Whether a motorcyclist hits a car, or just the ground, the biker can be hurt severely.
Florida law provides that a permanent injury is not necessary for a pain and suffering claim against the at-fault motorist. In fact, since No-Fault Insurance and mandatory PIP (Personal Injury Protection) do not apply to motorcycle accidents, claims against the at-fault motorist start immediately, unless there is some other first party insurance.
Most injuries are severe, as stated, but even a "road burn" injury is compensable.
Florida law provides that a helmet need not be worn by a biker, although there is a requirement that a $10,000.00 medical policy be purchased for helmet-less riding.
At the Law Offices of Greg Kimball, P.A., we have handled hundreds of motorcycle accident cases over the years. We will carefully investigate how the accident occurred to attempt to obtain the best possible recovery for you.
Greg Kimball formerly had an office on Main Street in Daytona Beach, the center of Bike Week and Biketoberfest. Greg Kimball has been a guest speaker about motorcycle accidents on JD’s Rock N Road Motorcycle Show on WFOY in St. Augustine.
